<p class="has-base-font-size">At its semi-annual National Committee Meeting, held in Sparks, Nevada, the Constitution Party passed a resolution to &#8220;Defend Education Against State &#8211; Funded Intrusion.&#8221;  </p>



<p class="has-base-font-size">It states, in part, that </p>



<p class="has-base-font-size">&#8220;The Constitution of the United States delegates no explicit authority to the federal government to tax or fund education, or to regulate education. All such powers are reserved to the states, or to the people of the states, under the Tenth Amendment.</p>



<p class="has-base-font-size">All human rights, including the right to govern one’s household and direct the upbringing and education of children, are endowed by the Creator and not granted by any government.</p>



<p class="has-base-font-size">The family is the first and foundational unit of government, with parents bearing the full responsibility and authority to educate their children as a matter of natural and divine law.</p>



<p class="has-base-font-size">The State does not own children, and it has no rightful claim over the direction of their education, particularly when such education is privately funded or directed within the home.&#8221;</p>



<p><strong>The Constitution Party declares&nbsp;</strong>that all forms of tax-funded subsidies for non-public education are unconstitutional, immoral, and<br>incompatible with the principles of individual liberty, private property, and family sovereignty.</p>



<p><strong>The Constitution Party calls</strong>&nbsp;upon the legislatures of all fifty states to nullify, reject, and repeal any existing tax-funded programs that subsidize private, religious, or home education, and to refrain from enacting any such programs in the future.</p>



<p><strong>The Constitution Party rejects</strong>&nbsp;the redefinition of programs like ESAs as public education and affirms that such reclassification undermines both the integrity of public schooling and the independence of private and home education.</p>



<p><strong>The Constitution Party affirms</strong>&nbsp;the sacred right of parents to educate their children without enticement, interference, or coercion by the State.</p>



<p><strong>The Constitution Party rejects any claim</strong>—explicit or implied—that children are wards of the State, and we declare that no government has authority to intrude upon the God-given hierarchy of the family, where parents, not politicians, are the rightful stewards of the next generation.</p>



<p><strong>The Constitution Party warns&nbsp;</strong>all liberty-minded citizens, churches,<br>homeschool associations, and private educators that the rebranding of ESAs as “public education” is a Trojan horse for expanded government regulation, surveillance, and eventual control over private and home education. We urge all who value liberty to oppose this deceptive promise of state-funded “choice” and to defend the necessary wall of<br>separation between education and state control.</p>

<h2 class="wp-block-heading is-style-default">The U.S. Constitution is signed September 17, 1787</h2>

<p class="has-medium-font-size">The signing of the U.S. Constitution, by the delegates of the Convention of 1787, begins its long journey to ratification. The delegates had met for months creating a new government in secrecy. It was now being sent on to the Congress with the recommendation to send it on to the States for ratification.</p>



<p class="has-medium-font-size">But ratification was not a foregone conclusion. The Convention had created a new constitution rather than attempt to modify the old one to cure the problems facing our States. The Framers created a confederated republic using fundamentals from other systems. The public were faced with a new animal, and needed time to explore it, have it explained, and have questions answered.</p>



<p class="has-medium-font-size">The debates that raged through the States, in newspaper and flyers and in the ratification conventions, provide us with many insights into the views and understandings that Americans had of the new document.<br>It took nine months for the required nine States to ratify the new constitution and it took nearly two and a half years to get all thirteen States to ratify it.</p>



<p class="has-medium-font-size">Today we have people pushing for another convention to open up the U.S. Constitution for changes; great and small. The Constitution Party opposes these attempts that put the constitutional protections of our natural rights at risk, and we encourage everyone to contact their State legislatures to tell them to refuse to go along with such efforts. We also encourage those in States that have made application or passed resolutions, to contact their State legislatures to call for a recission.</p>

<p class="has-medium-font-size">Sir,</p>



<p class="has-medium-font-size">We have now the honor to submit to the consideration of the United States in Congress assembled, that Constitution which has appeared to us the most adviseable.</p>



<p class="has-medium-font-size">The friends of our country have long seen and desired, that the power of making war, peace, and treaties, that of levying money and regulating commerce, and the correspondent executive and judicial authorities should be fully and effectually vested in the general government of the Union: But the impropriety of delegating such extensive trust to one body of men is evident-Hence results the necessity of a different organization.</p>



<p class="has-medium-font-size">It is obviously impracticable in the federal government of these states, to secure all rights of independent sovereignty to each, and yet provide for the interest and safety of all: Individuals entering into society, must give up a share of liberty to preserve the rest. The magnitude of the sacrifice must depend as well on situation and circumstance, as on the object to be obtained. It is at all times difficult to draw with precision the line between those rights which must be surrendered, and those which may be reserved; and on the present occasion this difficulty was encreased by a difference among the several states as to their situation, extent, habits, and particular interests.</p>



<p class="has-medium-font-size">In all our deliberations on this subject we kept steadily in our view, that which appears to us the greatest interest of every true American, the consolidation of our Union, in which is involved our prosperity, felicity, safety, perhaps our national existence. This important consideration, seriously and deeply impressed on our minds, led each state in the Convention to be less rigid on points of inferior magnitude, than might have been otherwise expected; and thus the Constitution, which we now present, is the result of a spirit of amity, and of that mutual deference and concession which the peculiarity of our political situation rendered indispensible.</p>



<p class="has-medium-font-size">That it will meet the full and entire approbation of every state is not perhaps to be expected; but each will doubtless consider, that had her interest been alone consulted, the consequences might have been particularly disagreeable or injurious to others; that it is liable to as few exceptions as could reasonably have been expected, we hope and believe; that it may promote the lasting welfare of that country so dear to us all, and secure her freedom and happiness, is our most ardent wish.</p>

<p class="has-medium-font-size"><strong>Article II, Section I of the U.S. Constitution states, in part:&nbsp;</strong></p>

<p class="has-medium-font-size"><em>&#8220;Each state shall appoint, in such manner as the legislature thereof may direct, a number of electors, equal to the whole Number of Senators and representatives to which the state may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an elector.&#8221;&nbsp;</em></p>

<p class="has-medium-font-size">This established the Electoral College.&nbsp;</p>

<p class="has-medium-font-size">The Constitution <strong>does not provide</strong> for the election of the President and Vice President of the United States by popular vote, but rather by the selection of “Electors” according to rules adopted by each state’s legislators.&nbsp;</p>



<p class="has-medium-font-size">These electors would receive the list of certified candidates. They would then cast their vote for whomever they ascertained as best qualified to fill these two highest offices of trust with the federal government.&nbsp;</p>



<p class="has-medium-font-size">The Constitution <strong>does not require</strong> the states to adhere to any specific manner in electing these electors or how they cast their votes.</p>



<p class="has-medium-font-size">Its wording does suggest that prominent individuals from each congressional district, and the state at large, would be elected or appointed as electors who represent that district.&nbsp;</p>



<ul class="wp-block-list">
<li class="has-medium-font-size">A voter would vote for three individuals, one to represent his district and two &#8220;at large&#8221; representatives to represent his state.&nbsp;</li>



<li class="has-medium-font-size">These electors, in turn, would then carefully and deliberately select the candidate for president.&nbsp;</li>



<li class="has-medium-font-size">Under this system, each congressional district could, in essence, select a different candidate.&nbsp;</li>



<li class="has-medium-font-size">The candidate with the most electors nationwide would become the next president.&nbsp;</li>



<li class="has-medium-font-size">This was the method used until the 1830s, at which time all the states, except for South Carolina, changed to a &#8220;general ticket.&#8221;</li>

<p class="has-medium-font-size">Under the Electoral College, no single faction or region of the country can elect a president, ensuring broad representation across the United States. </p>



<p class="has-contrast-color has-text-color has-link-color has-roboto-font-family has-medium-font-size wp-elements-840ea4a2741e418ac13c006383f438b1" style="font-style:normal;font-weight:600">REMOVE THE “GENERAL TICKET” SYSTEM</p>



<p class="has-medium-font-size">The &#8220;general ticket&#8221; system is still in use today. Inherently, it causes corruption because of the inequitable transfer of power from congressional districts to the states and large cities at the expense of rural communities.&nbsp;</p>



<p class="has-contrast-color has-text-color has-link-color has-roboto-font-family has-medium-font-size wp-elements-e2212a61c232211b575023500a6b813c" style="font-style:normal;font-weight:600">DEFEAT THE NATIONAL POPULAR VOTE PROPOSAL</p>



<p class="has-medium-font-size">The National Popular Vote system is a dangerous threat to our Constitutional Republic, allowing as few as eighteen to twenty-one states to circumvent the constitutional requirement of thirty-eight states to amend the Constitution.&nbsp;</p>



<p class="has-medium-font-size">The National Popular Vote process would effectively eliminate the last vestiges of the Electoral College, as originally set forth in the United States Constitution.&nbsp;</p>



<p class="has-medium-font-size">The National Popular Vote creates a fake majority by forcing electors to vote against the votes cast by their constituents.&nbsp;</p>



<p class="has-medium-font-size">Eliminating the Electoral College would instantly make the votes of Americans in approximately twenty-five states irrelevant.&nbsp;</p>



<p class="has-medium-font-size">Candidates would only be interested in campaigning in large population states, making small states meaningless zeros.&nbsp;</p>



<p class="has-medium-font-size">There is no threshold of what constitutes a “majority” under National Popular Vote. Therefore, a presidential candidate could be elected with as little as 15% of the popular vote.&nbsp;</p>



<p class="has-medium-font-size">Under the National Popular Vote scheme, chaos would ensue in any close election.&nbsp;</p>

<p class="has-medium-font-size">The Constitution Party encourages states to eliminate the &#8220;general ticket&#8221; system and return to the procedure intended by the Framers.&nbsp;</p>

<p class="has-medium-font-size">The Constitution grants the federal government <strong>NO authority</strong> over Education.</p>

Education as a whole, therefore, cannot be separated from religious faith. The law of our Creator assigns the authority and responsibility of educating children to their parents.</p>

<p class="has-medium-font-size">Federal control of Education has long been championed by communists and humanists as a means of overtaking and corrupting our American way of life.</p>

<h3 class="wp-block-heading">THE SOLUTION</h3>



<p class="has-accent-5-background-color has-background has-medium-font-size">Update to this section via 2025 Resolution: <a href="https://constitutionparty.com/defend-educational-freedom-from-state-funded-intrusion/">Defend Educational Freedom from State-Funded Intrusion</a></p>



<ul class="wp-block-list">
<li class="has-medium-font-size">Education should be free from all federal government subsidies, including vouchers, tax incentives, and loans, except with respect to veterans.</li>



<li class="has-medium-font-size">We support the&nbsp;unimpeded right of<strong>&nbsp;</strong>parents<strong>&nbsp;</strong>to provide for the education of their children in the manner they deem best, including home, private or religious.</li>



<li class="has-medium-font-size">All<em>&nbsp;</em>legislation from any level of government that would interfere with or restrict that liberty should be opposed.</li>



<li class="has-medium-font-size">Equitable tax relief for families whose children do not attend government schools should be provided for.&nbsp; This could be in the form of tuition write-offs.</li>



<li class="has-medium-font-size">Compulsory attendance laws should be repealed. Parents need not defy the law by refusing to send their children to schools of which they disapprove.</li>



<li class="has-medium-font-size">We affirm the free market principles which drive improvement of education through non-traditional options such as internet-based schools, charter schools, Christian and private schools, as well as home schooling options.</li>
</ul>

<li>There is <strong>NO Constitutional provision</strong> that empowers the federal government to provide for and regulate the education of our children.</li>
</ul>



<ul class="wp-block-list has-medium-font-size">
<li>All current federal legislation related to education should be repealed.&nbsp;</li>



<li>No new federal laws subsidizing or regulating education should be enacted.</li>
</ul>

<p class="has-accent-1-color has-text-color has-link-color has-medium-font-size wp-elements-409eab2bbc0bc741ccb249bff13325a5" style="font-style:normal;font-weight:600"><strong>WE OPPOSE ANY FEDERAL CONTROL OVER THE EDUCATION OF CHILDREN:</strong></p>



<ul class="wp-block-list">
<li class="has-medium-font-size">Because control over education is now being relegated to departments other than the Department of Education, we clarify that <strong>NO federal agency, department, board, or other entity</strong> may exercise jurisdiction over any aspect of children’s upbringing. Education, training, and discipline of children are properly placed in the domain of their parents.</li>



<li class="has-medium-font-size"><strong>Under NO circumstances</strong> should the federal government be involved in national teacher certification, educational curricula, textbook selection, learning standards, comprehensive sex education, psychological and psychiatric research testing programs, and personnel.</li>

<h3 class="wp-block-heading">THE CONSTITUTION PARTY COMMITTMENT</h3>

<li class="has-medium-font-size"><strong>Nullify</strong> the “No Child Left Behind” Act, and all other similar legislative actions.</li>



<li class="has-medium-font-size"><strong>Remove</strong> all regulations imposed by the Department of Education.</li>



<li class="has-medium-font-size"><strong>Reject</strong> federal monies for grades K-12.</li>

<p class="has-medium-font-size"><strong>The Constitution Party will uphold the right of states and localities to restrict access to drugs and to enforce such restrictions.&nbsp;</strong></p>



<p class="has-medium-font-size"><strong>We support legislation</strong> to stop the flow of illegal drugs into the United States from foreign sources. As a matter of self-defense, retaliatory policies, including embargoes, sanctions, and tariffs, should be considered.&nbsp;</p>

<p class="has-medium-font-size"><strong>We call upon the states</strong>, therefore, to decline to accept all monies from the federal government for any purpose not specifically and clearly articulated in the Constitution, and reject all federal mandates and regulations which are unconstitutional, thus restoring the intended balance of power between the states and their creation, the U.S. Government.</p>
